CHRISTOPHER PISACANE is an experienced litigator concentrating his practice in the areas of business law and commercial disputes.  Mr. Pisacane is admitted to practice in the state and federal courts of New York and New Jersey.  Mr. Pisacane has successfully represented clients in a wide array of commercial disputes in state and federal courts as well as before various arbitration forums, including the American Arbitration Association.  Prior to joining Clark Guldin, Mr. Pisacane worked at two New York City law firms where he litigated complex commercial matters, including contract disputes, insurance-related claims, debtor-creditor law, fraud, tortious interference, breach of fiduciary duty, investment-related claims, employment disputes, partnership disputes and securities arbitration.

Of note, Mr. Pisacane has:

  • Successfully litigated an appeal before the United States Court of Appeals for the 2nd Circuit, where the 2nd Circuit affirmed the lower court’s dismissal of a complaint against an insurance agent on the ground that the claims were preempted by federal ERISA law
  • Obtained summary judgment dismissing breach of contract claims for investment firm surrounding alleged failure to pay promissory note
  • Obtained summary judgment dismissing breach of fiduciary duty, negligence and fraud claims on behalf of insurance broker in broker liability action
  • Obtained dismissal of tortious interference claim on behalf of financial institution in commercial real estate dispute

Prior to entering private practice, Mr. Pisacane clerked for three years for the Hon. Shirley Werner Kornreich in the Commercial Division of New York State Supreme Court.  As a law clerk, Mr. Pisacane worked on a wide array of complex commercial matters including claims for fraud, breach of fiduciary duty, breach of contract, commercial real estate and class actions.
