Peter L. Skolnik concentrates his practice in the areas of media and entertainment law, First Amendment law, copyrights, trademarks and trade secrets, and complex civil litigation.  He advises and litigates around the country for high tech companies, publishers, broadcasters, authors, artists and athletes, literary estates and arts organizations.

Significant Matters

Mr. Skolnik represented the Estate of Vladimir Nabokov successfully in a highly celebrated case involving infringement of the copyright to Lolita; successfully defended David Chase, creator of The Sopranos, through litigation and trial concerning early development of the enormously successful television series; and defended filmmaker Jamie Johnson against an invasion of privacy suit arising from his award-winning documentary for HBO, Born Rich, in which Mr. Skolnik appears.  He has successfully negotiated contract matters for, among others, actress Ginnifer Goodwin, and prima ballerina Suzanne Farrell.  Mr. Skolnik also litigated on behalf of Les Ballets Trockadero de Monte Carlo to halt infringements of its trademark in Japan, and mounted an effective First Amendment pro bono defense of cult expert Rick Ross, in defamation litigation brought by Landmark Education concerning criticisms of Landmark’s “Forum” that appear on Ross’s web site.

Mr. Skolnik’s media law practice includes representing media organizations in defamation actions and actions to obtain access to courtrooms and court records. He is a co-author of the New Jersey section in the Media Law Resource Center’s Annual 50-State Survey of Privacy and Related Torts.  His trademark litigation practice includes enforcement of licensing agreements and restrictive covenants, the application of U.S. law to acts of infringement abroad and other issues.

Mr. Skolnik is regularly listed among The Best Lawyers in America for his First Amendment work.  In addition, he was profiled in the inaugural 2005 edition of New Jersey Super Lawyers, and has been recognized by his peers as a First Amendment/Media Law Super Lawyer every year thereafter.

Peter is the President of the New Jersey Volunteer Lawyers for the Arts (NJVLA) and Chair of the New Jersey Media Lawyers Association (NJMLA).  From 2004-2010, he was an Adjunct Professor of International Copyright Law at the Benjamin N. Cardozo School of Law, has been an Adjunct Professor of Publishing Law at New York Law School, and was formerly both a successful theatrical producer/director and seven-term president of a national association of literary agents.

JOHN E. CLARK is the founding and managing member of the Firm, establishing the firm in November 2010.  Mr. Clark concentrates his practice in the areas of business law, construction law & litigation, and business litigation and dispute resolution, and provides counseling and advice to a businesses and individuals concerning a wide range of business ventures, transactions and disputes.

He is admitted to practice in the state and federal courts in New Jersey and New York. Prior to founding the Firm, Mr. Clark was most recently a Member of Epstein Becker & Green, a 350 lawyer national law firm headquartered in New York, where he led the construction law practice in New York, New Jersey and the Northeast. Prior to EBG, Mr. Clark was for two years the Vice President & Chief Counsel of New Jersey Schools Development Authority, brought in as part of the agency reforms instituted by the then-newly elected Governor Jon S. Corzine. Prior to his stint at NJSDA, Mr. Clark practiced law at Lowenstein Sandler PC, an AMLaw 200 firm in Roseland, New Jersey.

In his construction law practice, Mr. Clark represents real estate owners, developers, and construction firms throughout all phases of the development and construction process. Mr. Clark:

  • Counsels clients on project delivery and contract formation, and drafts and negotiates contracts for design, construction, supervision and consulting services
  • Advises clients on dispute and delay avoidance, risk assessment and management, and claims minimization during the construction process
  • Represents owners, developers, contractors, design professionals and consultants regarding design and construction claims and disputes in ADR proceedings, and, when necessary, in litigation in state and federal courts
  • Represents owners and contractors in construction defect disputes and litigation
  • Represents owners and contractors in informal dispute resolution including negotiations and mediation

He has advised real estate owners and contractors and private, institutional and public owners throughout the United States on the development and renovation of a wide range of facilities, including hospitals and health care, hotels, commercial office, industrial and factory, luxury retail, shopping centers, food service, residential, condominium and cooperative apartment buildings, athletic, laboratory and scientific, and schools and higher education. He counsels clients on project delivery and contract formation and negotiation, provides advice during project construction, and assists clients in resolving disputes through ADR and, if necessary, litigation. He has advised clients on the design and construction of approximately $12 billion in new and renovation construction throughout his career.

At NJSDA, Mr. Clark directed legal matters related to NJSDA’s multi-billion dollar development portfolio, including land acquisition, environmental remediation, design, construction and dispute resolution. He also developed and directed a claims resolution process of analysis, stepped negotiation and mediation, resulting in the favorable settlement of more than $40 million in claims within the span of fifteen months. Just prior to his departure from NJSDA Mr. Clark represented the New Jersey Schools Development Authority in a mediation that resulted in the Authority obtaining a settlement against a contractor and architect for $6.5 million, for their part in the defective design and construction of an elementary school that caused mold contamination in the partially constructed building.

In addition to his extensive experience in construction law, Mr. Clark has also successfully handled a wide variety of business disputes in state and federal courts in Massachusetts, California, Florida, Nevada and Illinois involving a broad range of issues, such as securities, trade secrets, public contracts, credit instruments, shareholder rights, and international intellectual property rights for individual, corporate and institutional clients.

Prior to practicing law, Mr. Clark was involved in various businesses, including managing a specialty contracting firm in New York, and other ventures including restaurants, and specialty food marketing.  He began his career in the construction industry as a project manager for a New York City developer.

Mr. Clark lectures on construction law topics and has been an adjunct professor of philosophy at his alma mater, Rutgers University.  He currently represents Make It Right Foundation in support of the Foundation’s efforts to rebuild the Lower Ninth Ward in New Orleans in the wake of Hurricane Katrina.

Jonathan T. Guldin has a broad range of experience litigating commercial disputes of all types, and has developed a special emphasis in litigating business divorce, construction and consumer fraud cases.  Mr. Guldin has a reputation among his clients and peers for effective representation of his clients’ interests, and has been featured as one of New Jersey’s Rising Stars in Super Lawyers multiple times over the last few years.

Mr. Guldin graduated from Seton Hall Law School, magna cum laude, and immediately joined the litigation department at Lowenstein Sandler PC, an AMLaw 200 firm with offices in New Jersey and New York.  While at Lowenstein Sandler, Mr. Guldin became the lead associate in the construction law practice group and, in 2009, assisted in launching the firm’s business divorce group.

In March 2010, Mr. Guldin joined forces with his former colleague, John Clark, and helped establish J Clark & Associates.  At J Clark & Associates, Mr. Guldin has continued representing clients in business divorce and construction matters, and otherwise represents both plaintiffs and defendants in a variety of business disputes.  Unburdened by the “big firm” hierarchy and billing structures, Mr. Guldin is involved from start to finish in every step of his clients’ matters and, therefore, is able to better advocate for his clients’ causes and do so more cost effectively as well.

Mr. Guldin has scored significant victories on behalf of his clients in state and federal courts, and through alternative dispute processes, such as arbitration and mediation.  He regularly litigates cases and appears in courts in both New Jersey and New York, and arbitrates matters before the American Arbitration Association.  Mr. Guldin has also successfully defended appeals before the New Jersey Appellate Division and Third Circuit Court of Appeals.
